ALTERNATIVE RESOLUTION TO DISPUTES
The website www.glugulp.com hosts a technology platform, conceived and managed by Glugulp srl and offers a so-called "Marketplace" (i.e. a virtual shop where the site offers and sells its products: thir party sellers, other than GLUGULP!, can also conclude related purchase contracts,.
The site therefore allows users to purchase both products and/or services sold by GLUGULP!, and products and/or services sold by third-party vendors within the marketplace. The site always clearly indicates if the product and/or service is sold by GLUGULP! or by a third party vendor. In the event that the user purchases from a third party vendor, other than GLUGULP!, the contract is concluded between the user and that third party only.
If you have filed a complaint about a contract concluded with GLUGULP! or a third-party vendor, but it was not possible to resolve it, remember that the online dispute resolution service is established by law.
You can find a summary below containing further information on Alternative Dispute Resolution; this information refers to any disputes that may arise in relation to a contract concluded with GLUGULP! with respect to the products and/or services specifically indicated on the site as "sold and shipped from GLUGULP!", and any disputes arising in connection with a contract concluded with a third-party vendor of the marketplace with regard to the products and/or services offered for sale by the latter.
Regarding complaints relating to contracts concluded with a third-party vendor, it should be remembered in any case that the latter will provide you with detailed information on its possible adherence to one or more Alternative Dispute Resolution bodies for the out-of-court settlement of disputes directly on the Vendor File page, which you can visit by accessing the site.
For any further information, please do not hesitate to contact GLUGULP! Customer Service, according to the terms and addresses listed in our Contacts page of this site for contracts concluded with GLUGULP! and, for contracts concluded with a third-party vendor, through the dedicated platform messaging system that you can access from the private area of your personal account.
LEGAL NOTICES
ALTERNATIVE DISPUTE RESOLUTION (ADR)/ONLINE DISPUTE RESOLUTION (ODR)
From January 9, 2016, some new provisions have been introduced, especially by D.Lgs. 6 August 2015, no. 130 and by EU Regulation no. 524/2013 on Alternative Dispute Resolution and Online Dispute Resolution.
The purpose of this legislation is to encourage friendly resolution of disputes between professionals and consumers through alternative methods, such as the Alternative Dispute Resolution (ADR) and the Online Dispute Resolution (ODR).
To this end, a European Dispute Resolution platform (http://dec.europa.eu/consumers/odr/) was created. Through the ODR platform, consumers will be able to know the list of ADR bodies, find the link to each of them and start an online dispute resolution procedure for an online contract they are involved in.
At this time, GLUGULP! does not use any ADRs referred to in art. 141-bis and ss. Consumption Code. As far as third party sellers are concerned, each of them will indicate - directly in our Vendor File page, which you can access by visiting the site - detailed information about its possible adherence to one or more ADR entities.
In any case, whatever the outcome of the out-of-court settlement procedure, you have the right to appeal to the ordinary court and, if the conditions are met, to promote an out-of-court settlement of consumer disputes following the procedures in Part V, Title II-bis Consumption Code.
MODIFICATION OF GENERAL TERMS
The General Sales Terms may be changed at any time. Any changes and/or new conditions will immediately be effective.
